What is the Condition for Applying the Serial Trial Procedure in Cases of Joint Participation in a Crime?

The Serial Trial Procedure is a fast-trial method that can be applied to certain crimes during the investigation phase. However, if the crime is committed jointly by multiple individuals (joint participation), the application of this procedure depends on an additional condition.

Condition for Applying the Expedited Trial Procedure in Cases of Multiple Participants

If the crime was committed jointly, it is mandatory that all suspects together accept the expedited trial procedure.
In other words:

  • If even one of the suspects does not accept the procedure,
  • The prosecutor cannot offer the expedited trial for any suspect,
  • The investigation continues through the normal procedure.

This regulation aims to ensure that the intentions of all suspects acting together are aligned and that the trial process is conducted fairly.
