What Happens if the Suspect Fails to Appear at Court Without Excuse in Expedited Trial Procedure?
- If the suspect does not attend the expedited trial hearing set by the court without a valid excuse, by law:
➡ The suspect is considered to have waived the expedited trial procedure.
This means that the suspect’s previously expressed consent loses validity because they fail to reaffirm it during the hearing.
- If the suspect does not appear without an excuse, the court:
➡ Forwards the file to the Public Prosecutor's Office for processing under general procedural rules.
After this stage:
- The expedited trial procedure ends,
- The investigation returns to the ordinary procedure,
- The public prosecutor continues the case under the provisions of classical criminal procedure.
