Why Are Specialization Areas in Mediation Determined?

In the announcement published by the Directorate, it is stated that with the expansion of the court-annexed mediation system, the need to define specialization areas according to the type of disputes has emerged. This approach aims to ensure that mediation activities are carried out with knowledge and expertise appropriate to the nature of the dispute.

The determination of specialization areas in mediation is particularly important in disputes that require technical, sector-specific, or legally specialized knowledge. For this reason, labor law, commercial law, and consumer law have been designated as general specialization areas; in addition, some special specialization areas have also been established.

What Are the General Specialization Areas?

In the announcement of the Mediation Directorate, the general specialization areas are listed as follows:

  1. General Specialization Area of Labor Law

  2. General Specialization Area of Commercial Law

  3. General Specialization Area of Consumer Law

What Are the Special Specialization Areas?

  1. Special Specialization Area of Banking and Finance Law

  2. Special Specialization Area of Insurance Law

  3. Special Specialization Area of Construction Law

Who Are Mediation Sub-Specialization Trainings For?

Mediation sub-specialization trainings are intended for registered mediators. These trainings are considered specialization programs aimed at conveying theoretical and practical knowledge related to the relevant field of law.

How Is Assignment Done in Specialized Mediation Practice?

In the announcement regarding the implementation of specialization areas published by the Directorate, it is stated that if a dispute subject to court-annexed mediation falls within one of the special specialization areas, the case will be assigned to a mediator specialized in that field.

If there is no mediator specialized in the relevant field, it is stated that mediators with general specialization may be assigned depending on the nature of the dispute.

The Relationship Between Specialization Training and Refresher Training

Within the scope of the announcement published by the Mediation Directorate regarding refresher trainings:

  • Mediators who have passed 3 years since their last specialization training in any field are required to attend refresher training.

  • Mediators who have passed 3 years since their registration in the mediation registry and have not received refresher training or any specialization training are required to attend refresher training.

These trainings provide an important structure that supports specialization according to dispute types in mediation practice. Mediators planning to receive specialization training should follow the latest announcements and relevant procedures and principles published by the Directorate.
