2024 Minimum Fee Schedule for Expert Witnesses

The expert witness is additionally reimbursed for examination, transportation, accommodation, meals, and other customary expenses related to the nature of the assignment upon submission of supporting documents. Payments are made considering prevailing rates, and the submitted documents are kept in the file.

ARTICLE 4

(1) The expert fee is the payment made to the expert in return for the effort and time spent.

Expenses

ARTICLE 5

(1) Expenses incurred by the expert for examination, transportation, accommodation, meals, and other customary costs related to the assignment are paid separately upon submission of receipts. Payments are made considering market rates and submitted documents are kept in the file.

Expert fees for natural persons

ARTICLE 6

(1) Expert fees payable to natural persons according to this Tariff are shown below:

Expert fees for private law legal entities

ARTICLE 7
(1) According to this Tariff, private law legal entities are paid 3000,00 TL for the cases listed in Article 6.

Increase of fees specified in the Tariff

ARTICLE 8

(1) The assigning authority may, ex officio or upon request, increase the expert fees in this Tariff considering the following factors, in accordance with the ordinary course of life and constitutional right to seek justice:
a) The expert's qualifications or difficulties in obtaining an expert in the relevant field.
b) The nature of the dispute and the value of the subject matter.
c) Scope of the file and its annexes.
ç) Time required for the expert to reach the assigned location.
d) Time spent for examination.
e) If an on-site inspection is required, the time spent on the inspection.

Reduction of fees specified in the Tariff

ARTICLE 9

(1) The assigning authority may reduce the expert fees specified in this Tariff if the nature of the work so requires.

Expert fee for serial files

ARTICLE 10

(1) In serial files that do not require separate examination or research, a reduction of the expert fees in this Tariff may be made by the assigning authority depending on the nature of the work.

Expert fee for supplementary reports

ARTICLE 11

(1) If additional information is requested beyond the questions specified in the assignment, an extra fee may be paid to the expert according to the content of the request.
(2) No additional fee is paid if a supplementary report is requested to address deficiencies or ambiguities in the expert report.
(3) No additional fee is paid if one or more questions in the assignment are left unanswered by the expert and a supplementary report is requested.

Advance payment for expenses

ARTICLE 12

(1) Considering the expert's transportation and accommodation expenses and costs necessary for preparing the report, an advance payment may be made upon the expert’s request and the approval of the assigning authority, to be deducted from the amount to be paid according to Article 5.

Non-payment of fees

ARTICLE 13

(1) If a report is prepared contrary to the assignment under Article 51 of the Expert Regulation, the assigning authority may decide not to make a payment or to reduce the fees and expenses depending on the nature of the violation.

Payment of fees

ARTICLE 14

(1) After deducting taxes, the remaining expert fee is paid to the expert.
(2) Expenses determined according to Article 5 are paid separately without any deduction.

Applicable Tariff

ARTICLE 15

(1) The tariff in force at the date of assignment shall be used for determining the expert fee.
